Terms & Conditions

These Terms & Conditions (the "Terms") are an agreement between you and SmartPref S.àr.l.-S, Luxembourg, registered with the Luxembourg Business Registers under number B308734 ("SmartPref", "we", "us" or "our"). They govern your use of the Solitaire Club mobile application, its online services, and this website (together, the "Service").

By downloading, accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. Mandatory consumer rights that apply where you live are not limited by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If local law requires a higher age for you to consent to online services or data processing, you must meet that age or have permission from a parent or legal guardian.

2. License to use Solitaire Club

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use Solitaire Club on devices you own or control, subject to these Terms and the rules of the store from which you obtained it. Updates that replace or supplement the app are covered by this license unless accompanied by separate terms.

You may not copy, sell, rent, distribute, modify, reverse engineer, decompile, disassemble, derive source code from, bypass security or technical restrictions in, or create derivative works from the Service, except where applicable law expressly permits it.

3. The Service

Solitaire Club provides single-player solitaire games, hints, progress features, community statistics and optional account services. Some play works offline; account sync, community results, advertising, purchases and other online features require a network connection. We may improve, change, suspend or discontinue features when reasonably necessary.

"Winnable" or similar descriptions mean that our software has found a valid winning line from the initial deal under the applicable game rules. They do not guarantee that every sequence of moves remains winnable or that every player will complete a deal.

4. Accounts and security

You can play without creating a credentialed account. If you create or connect an account, you must provide accurate information, keep your credentials secure, and promptly tell us if you suspect unauthorized access. You are responsible for activity through your account unless it results from our failure to use reasonable care.

Usernames and profile images must not be unlawful, abusive, misleading, infringing, or impersonate another person. We may remove profile content or restrict an account when reasonably necessary to enforce these Terms or protect the Service and its users.

5. Your profile content

You retain ownership of a username or profile image you submit. You give us a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, display and transmit that content only as needed to operate and improve the Service. This license ends when the content is deleted, except for temporary backups or where retention is legally required.

6. Purchases

The Lifetime Club Pass is a one-time, non-consumable in-app purchase that removes Solitaire Club transition ads for the entitled account. It does not promise future content, other paid benefits, or the removal of storefront or service notices. The price and currency shown by Apple App Store or Google Play at checkout control.

Purchases are processed by the applicable store and are subject to its payment, family-sharing, cancellation and refund rules. We verify purchase records to grant and restore access. Except where law requires otherwise, refund requests must be made through the store. An entitlement may be suspended or revoked if the store reports that a transaction was refunded, reversed, invalid or fraudulent.

7. Advertising

The free Service may show third-party ads. Ad availability, format and frequency may change. Where required, advertising and consent choices are provided through the app. Declining optional ad personalization does not prevent you from playing.

8. Acceptable use

You must not misuse the Service, including by cheating or submitting fabricated results; probing or disrupting its security or availability; accessing it through unauthorized automated means; uploading malicious code; infringing others' rights; harvesting user information; or using it for unlawful, fraudulent or abusive activity.

9. Intellectual property

The Service, including its software, game presentation, artwork, characters, text, trademarks and other content, is owned by SmartPref or its licensors and is protected by intellectual-property laws. No rights are granted except the limited license in these Terms. Third-party names and marks belong to their respective owners.

10. Third-party services

The Service may interact with Apple, Google, advertising, analytics, crash-reporting, authentication and other third-party services. Their own terms and privacy policies govern their services. We are not responsible for third-party services outside our control, but this does not exclude responsibility that applicable law places on us.

11. Maintenance and support

SmartPref, not Apple or Google, is responsible for maintenance and support for Solitaire Club. We do not promise that the Service will always be available, uninterrupted or compatible with every device or operating-system version.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, permanent preservation of local progress, or that online information will always be complete or current. These exclusions do not apply where prohibited by law.

13. Limitation of liability

To the maximum extent permitted by law, SmartPref is not liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, profits, revenue or goodwill arising from the Service. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury, or any liability or consumer remedy that cannot lawfully be excluded.

14. Suspension and termination

You may stop using the Service at any time and may delete a credentialed account from the app. We may suspend or terminate access if you materially or repeatedly breach these Terms, create risk or legal exposure, or if required by law. Where appropriate, we will give reasonable notice and an opportunity to remedy the issue. On termination, the license in section 2 ends.

15. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security or business practices. We will post the revised Terms and update the effective date. If a change materially affects your rights, we will provide additional notice where reasonably possible or legally required. Continued use after the revised Terms take effect means you accept them.

16. Governing law and disputes

These Terms are governed by the laws of Luxembourg, without regard to conflict-of-law rules. The courts of Luxembourg have jurisdiction, except that consumers may rely on mandatory protections and bring claims in any court available to them under applicable consumer law. Before filing a claim, please contact us so we can try to resolve it informally.

17. App-store terms

Apple and Google are not parties to these Terms and are not responsible for Solitaire Club. If you downloaded the app from Apple, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable license terms against you. If the app fails to conform to an applicable warranty, you may notify Apple; to the maximum extent permitted by law, Apple has no other warranty obligation. SmartPref, not the store, is responsible for product claims, support, and the investigation, defense and settlement of intellectual-property claims relating to the app.

You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on a United States government restricted-party list.

18. General

If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization or sale of the Service, subject to applicable law. These Terms and the Privacy Policy are the entire agreement about the Service unless additional written terms expressly apply.
